Unitech, Sunny Villa booked for delayed projects

After receiving multiple complaints, construction giants Unitech Ltd and Sunny Villa Cooperative Society were booked by the Gurgaon Police last week.

Nitin Saxena, well-known consumer activist, was one of the complainants to file a complaint against Unitech on March 15.  Following this, an FIR was registered against Unitech Limited, a leading real estate developer for prolonged delays in completion of Saxena’s residential project of an independent floor in South City-2 Gurgaon.

The complainant’s project was re-launched in July 2009 and the developer was to give possession of the floors by the end of 2011. However, the floor owners/complainants who have paid more than 95 per cent of the cost are yet to get possession.

However, this is not the first time that an FIR has been registered against Unitech Ltd. Police officials also informed that more than a dozen of police complaints have been registered against Unitech builders.

Nitin Saxena along with some of the NRIs and senior citizen has paid more than Rs three crore to Unitech Ltd by obtaining bank loan. Suprisingly, a total of four FIRs were registered against Unitech Limited within a week. On March 13, an FIR was registered by Aarti Kapoor, on March 15  Sunita Agarwal and Nitin Saxena and on March 16 Priya Rao filed FIRs against Unitech in Sector 40 police station.

Sources also revealed that the builders diverted the fund to its other projects or in some other risky investments. Gurgaon Police have implicated the promoters of the company and the top management of the Unitech under Sections 420/406 of the Indian Penal Code following an FIR by the Economic Offences Wing on March 15, 2016.

“Besides the inordinate delay, Unitech Limited has also been accused of using poor quality construction material. It is also a matter of record that the company has been regularly announcing its new projects from time to time,” said one of the complainants.

“While the CMD and other Directors gave false assurances that the independent floors at South City-2, Gurgaon was under completion, some top officials of M/s Unitech Ltd (Rana Banerjee) threatened to kill me if I raised voice against the builder,” added Saxena.

Now, Unitech and its top officials have been booked for allegedly cheating home buyers in the ‘Crestview’ residential project in Sector 70, police.

“An FIR has been registered against Unitech and its top officials. We have referred the case to EOW for investigation,” said SHO of Sector 40 police station. The FIR is registered under Sections 420 (cheating) and 406 of the IPC. On the direction of Economic Offences Wing, Gurgaon Police also registered a case against R P Wadhwa of the Sunny Villa Cooperative Society under Section 420 and 406 on the complaint of Rajinder Kaur resident of Defence Colony New Delhi who has not received the allotment of plot even after 20 years. He claims that the society has cheated thousands of other members.
