Talwar not to be arrested during pendency of the plea

Nupur Talwar, facing a non- bailable warrant(NBW), will not be arrested for now with CBI assuring the Supreme Court today it will not take any action against her during the pendency of her plea against the arrest warrant.

The assurance, which came as a reprieve for Nupur, was given during the hearing of the plea of the mother of the murdered teenager Aarushi against the NBW issued by a special CBI court in Ghaziabad, two days after the central agency searched her residence to execute the court warrant.

The CBI court in Ghaziabad while issuing the NBW on Wednesday fixed April 18 as the next date of hearing in connection with the case of twin murder of Aarushi and Hemraj in 2008 ordered her arrest and directed she be produced before it on that date. As soon as the proceedings on Nupur's plea began, a bench of justices A K Patnaik and J S Khehar expressed unhappiness over CBI's action against her and said she has to be protected.

Sensing the mood of the court, Additional Solicitor General Haren Raval, appearing for the investigating agency assured the court that no coercive action would be taken against her.

He informed the court that CBI was well aware of her movements but did not arrest her.

The bench after hearing Raval's contention said, "We have total faith in you" and referred Nupur's petition to the Chief Justice of India for its listing to an appropriate bench for its hearing.

The bench said it had entertained Nupur's plea yesterday under wrong impression that it was part of her review petition, being heard by it.

Nupur, who is allegedly evading arrest in the twin murder case, was present in the courtroom when the matter was being heard.

In an apparent bid to evade her arrest in the murder case, Nupur had yesterday moved the Supreme Court challenging the NBW.
