SC to hear plea against order summoning Anil, Tina Ambani

The Supreme Court will hear the case of summoning of Reliance ADAG chairman Anil Ambani and his wife Tina Ambani by a special court hearing the 2G scam on Tuesday.

In another development in the case, the trial court on Monday has summoned the couple to depose as prosecution witness for 26 July. On Monday, Reliance Telecom Ltd (RTL), facing trial in the case, moved the apex court challenging the order of the trial court, which had said that summoning of the couple and 11 others as prosecution witnesses was essential for arriving at a just decision in the case. RTL moved the apex court against the trial court order as the apex court had earlier restrained all other courts, including high court, from entertaining any plea arising out of 2G scam case.

A bench headed by Chief Justice of India P Sathasivam, before whom the matter was mentioned for an urgent hearing, agreed to hear the case and said it would be heard by an appropriate bench. The trial court had allowed Central Bureau of Investigation (CBI) plea that the testimony of Anil Ambani and Tina Ambani may throw light on alleged investment of over Rs 990 crore by his group companies in Swan Telecom, which is facing trial in the case along with its promoters Shahid Usman Balwa and Vinod Goenka.

Noting that Anil Ambani and Tina Ambani were holding responsible positions in Reliance ADA Group and the shell companies and their testimonies cannot said to be totally unnecessary or unconnected with the case, Special CBI judge O P Saini had said that testimony of Anil Ambani and Tina Ambani is required to prove the facts pertaining to incorporation of shell companies as some of the witnesses examined earlier have not been able to do so.
