Prosecution’s failure acquits two accused in Phoolan Devi murder case

Due to the prosecution’s failure, two out of three shooters who had killed bandit-turned-politician Phoolan Devi are still roaming freely as the court has only convicted the key accused Sher Singh Rana for the offence, while acquitting others.

Detailing all the circumstances and facts in the 217 pages judgement, additional session judge, Bharat Parashar has said ‘there were indeed three persons involved in the actual shooting incident. While the two fired at Phoolan Dev, the third person drove the two shooters from the spot.’

‘It is thus clear that the murder Phoolan Devi was carried out by accused Sher Singh Rana in furtherance of common intention shared by his other two accomplices whose identity could not be established by the prosecution in the present case,’ said the judge. Rana, during the hearing has supposedly asked the court, ‘Why have you convicted only me?’ To which the judge replied, ‘because of the evidence and fact I have found against you, this is the possible judgment I can write. You are free to file an appeal before the high court and challenge my order.’

The judge also said that it further gets support from the fact that after the incident, you (Sher Singh Rana) were found to be staying at hotels in Haridwar under false names. ‘I may also mention that one of the two revolvers recovered from the car had his fingerprints.’
