Multi-level parking near Ramlila: HC raps North MCD

The North Corporation had been evading the implementation of the court directions for commissioning the basement parking facility and providing the vehicles unhindered access to it. The civic body, in violation of the court’s directions, had been allotting the surface parking area in the parade ground to an entity for staging Ramlila. The court had also initiated contempt proceedings against the Corporation’s commissioner. 

However, later the contempt proceedings were dropped when he tendered an unconditional apology saying that “he feels remorse for what has happened” adding that he “hereby tenders <g data-gr-id="22">unconditional</g> apology in the matter.” The commissioner assured the court that “such a situation shall not occur in future.”

“The court makes it clear that any further lapse that the court has had to deal with will not be tolerated hereafter,” the court said. “There are three levels of the basement parking at the parade ground. It was evident from the experience during the Dussehra festival in 2013, that giving off the surface level parking area for holding the Ramlila celebration would block access to the basement levels.” 

“It required the court’s intervention in 2013 to ensure the access to the basement level parking. It is inexcusable that despite this the North MCD did not take corrective action in 2014. It is only after this court on September 30, 2014, expressed its displeasure that a circular dated on October 30, 2014, was issued stating that in the light of the orders of this court dated September 23, 2013, and October 7, 2013, it had to be ensured that there is no restraint of access to the basement levels of the parking.”
