‘Investigate Railway bribe case again’

The investigation in a graft case against a northern railway officer unfolded after a sting operation by a news channel has been found to be closed without a proper enquiry. The information revealed in the right to information [RTI] clearly states that the veracity of the CD was not taken into consideration.

According to the RTI applicant, Rajeev Sharma, the railways had said that none of the allegations made against the officer were found to be substantial. However, it was found that the enquiry was conducted with no scientific investigation on the CD and telephonic conversation.

Yogesh Kumar Aggarwal, Senior Transportation Manager, Planning and Establishment, Northern Railway, was caught taking bribe from a journalist in a sting operation in 2009, when he was posted as Divisional Operations Manager [DOM], Coaching in Delhi Division of Northern Railway.
The sting operation was shown on various news channels in 2010. Despite the charges against Aggarwal, he was not formally pulled up for the crime, claims the RTI report.

Responding to the RTI, the railways said that they received the said CD from the journalist, but they were reluctant to provide a copy. However no CD was sent to the forensic lab for testing.

They also have said that there was no telephonic conversation. Neither did they summon the reporter who conducted the sting operation.

About the inquiring officer, the RTI stated that the information sought cannot be provided since the disclosure for the information would endanger the life or physical safety of any person.

It was revealed in the RTI that there was no conclusive evidence available to pinpoint the exact averred culpability of Aggarwal. The dialogue which took place during the incident as shown in the CD footage indicate exchange of money and conversation between him and the decoy may not have been entirely bona fide, claim reports. It cannot at the same time be taken as evidence enough to hold Aggrawal responsible for the misdeed alleged in the complaint.

Sharma, has requested to Central Bureau of Investigation [CBI] for reinvestigation of complaint into graft case against Aggarwal.
