Hearing of CBI’s plea to cancel Mitra’s bail on Oct 5

Madan Mitra, the former transport minister, breathed a sigh of relief on Thursday when the Calcutta High Court decided the date of hearing on Central Bureau of Investigation (CBI) plea to cancel his bail on October 5.

Mitra was released on bail after spending two years in correctional home following his arrest in connection with Saradha Group scam. Though he is staying in a hotel in Bhowanipore as per the direction of the Alipore Court, he had expressed his wish in media to be with his family members during Durga Puja.

CBI on Thursday pleaded to submit the petition and other documents related to the case before Justice Nishita Mhatre and the date of <g data-gr-id="27">hearing</g> to the plea for cancellation of Mitra’s bail will be fixed on October 5.

The Court will remain closed from October 6 till after the Puja. Thus there is no question of hearing on CBI’s plea before the Puja. As a result, Mitra can spend this Puja staying in the hotel and can meet his family members.

CBI had earlier pleaded before the Chief Justice Girish Gupta seeking cancellation of Mitra’s bail.

It may be recalled that Alipore Court had granted the bail to Mitra on September 9.

This is not the first time when Mitra was given bail by the lower court. On October 31, 2015, Mitra was given bail by the lower court. But it was later rejected by the High Court in November 2015. Thus, Mitra had to walk into <g data-gr-id="33">correctional</g> home once again.

<g data-gr-id="30">Similarly this time</g> the CBI is once again bringing forward the theory of “influential person” for rejection of Mitra’s bail. The CBI had over and again submitted before the Court that Saradha Group scam is a case of “larger conspiracy” and Mitra, who was arrested in this connection, cannot be released as he was an influential person.
