Special court rejects 40 cases against AAP MLAs, Ministers

NEW DELHI: Special fast track courts has rejected at least 40 cases against 25 AAP legislators including Ministers. Court on Tuesday quashed a case registered against MLA Naresh Balyan on February 23. A court has also refused to direct the Delhi Police to lodge against Chief Minister Arvind Kejriwal, Deputy Chief Minister and others for wrongfully restraining and criminally intimidating a person during their sit-in protest at the Lieutenant office in June 2018.

It is very strange that the case was registered on the basis of a complaint lodged by a police personnel that Balyan had incited the crowd at a public meeting against IAS officers. Further, this fake FIR was used as an excuse by the IAS AGMUT Association to boycott meetings called by Delhi govt ministers for four months last year.

Further, IAS Association put this as a precondition that Delhi CM must publicly condemn Balyan before they come for talks with the govt. This fake FIR was publicised in TV channels & newspapers to defame the MLA. "In the end, truth has prevailed, IAS Association should now apologise to the people of Delhi for their lies & tell who instigated them to stall people's work for four months," said Delhi government spokesperson. Will BJP & other parties who unleashed a false propaganda apologise?

It is pertinent to mentioned that in the five and a half months since special fast track courts were set up in Delhi to hear cases involving sitting AAP MLAs have been completely discharged or acquiteted in 19 out of 22 cases filed by Delhi Police. A court has also refused to direct the Delhi Police to lodge against Chief Minister Arvind Kejriwal, Deputy CM and others for wrongfully restraininng and criminally intimidating a person during their sit-in- protest at the Lieutenant office in June 2018. According to Court orders , a lot of AAP MLAs such as Amanatullah Khan, Malviya Nagar MLA Somnath Bharti,Delhi Cant MLA Commando Surender Singh , Palam MLA Bhavna Gaur, Sangam Viahr MLA Dinesh Mohaniya, Kondly MLA Manoj Kumar, Model Town MLA Akhilesh Mani Tripathi and Tilak Nagar MLA Jarnail Singh have been acquitted.

The grounds for acquitting the MLAs in a majority of cases vary. In five cases Additional Chief Metropolitian Magistrate Samar Vishal cited late filing of chargesheet without any cgent explanation by Delhi Police.
