Court upholds jail sentence to man who cheated job aspirants

A man accused of cheating many job aspirants on pretext of getting them employment in government sector has been sent back to jail by a Delhi court which upheld the magistrate's order awarding him three years imprisonment.

Additional Session Judge Madhu Jain dismissed the appeal of R K Puram resident Babu Lal and directed that "accused be taken into custody".

"There is no infirmity or illegality in the order of the Metropolitan Magistrate convicting accused. Same is therefore upheld. So far as order of sentence is concerned, same also does not suffer from any illegality or infirmity considering the fact that accused cheated a large number of public in a similar fashion and also failed to return their money back.

"In such circumstances the order of sentence of trial court sentencing the appellant to rigorous imprisonment for three years and a fine of Rs 10,000...for the offence under section 420 (cheating) of IPC also does not call for any interference," the court said.

The order of the sessions court came on Babu Lal's plea challenging the magisterial court's 2011 order which sent him to jail for three years and imposed a fine of Rs 10,000 on him.

A complaint was lodged against Lal in February 2004, when he dishonestly induced one Kishan to give him Rs 45,000 on the pretext of getting him a government job but subsequently failed to return the money.

The prosecution had argued that Lal is a habitual cheater who had duped several persons in similar fashion.
