Court to consider CBI’s final report on Jan 30

“Certain clarifications have been sought qua the supplementary final report. Accordingly, matter be put up for consideration now on January 30,” Special CBI Judge Bharat Parashar said.
The court was hearing the case in which CBI had earlier chargesheeted Congress MP Vijay Darda, his son Devendra Darda, Director of AMR Iron and Steel Pvt Ltd, Manoj Jayaswal, and the firm, as accused for offences punishable under sections 120-B (criminal conspiracy) read with 420 (cheating) of IPC and under the provisions of Prevention of Corruption Act.
During the hearing, the court allowed Vijay Darda’s plea seeking modification of conditions which were imposed on him while he was granted bail last year.
Darda’s counsel Vijay Aggarwal told the court that while his client was granted bail, the court had directed him not to leave the country without its prior permission but he has to travel abroad for business purposes and also in connection with his official duties as an MP.
Aggarwal said that Vijay Darda would ensure his presence on each and every date of hearing and that the trial was not hampered on account of his foreign trips.
Senior public prosecutor A P Singh expressed apprehension that the trial could get hampered on account of his frequent foreign visits.
It is accordingly directed that henceforth before leaving the country accused (Vijay Darda) shall intimate the court not later than a week before the actual date of journey about his travel plan, itinerary and his contact addresses during the said travel,” the judge said.
“However, it is made clear that accused shall remain present on each date of hearing unless ordered otherwise, be it the stage of recording evidence or any proceeding before or after,” the court said.
The CBI had earlier informed the court about the current status of public servants, who were allegedly involved in the allocation of a coal block to AMR Iron and Steel Pvt Ltd.
The court had earlier granted bail to Vijay Darda, Devendra and Jayaswal after they had appeared before it in pursuance to the summons issued against them.
Vijay Darda, Devendra, Jayaswal and the firm were named as accused in the charge sheet filed by CBI on March 27 last year in which it had alleged that they had fraudulently acquired the coal blocks. Darda has denied the allegations against him. Regarding AMR Iron and Steel Pvt Ltd, CBI had claimed in its FIR that the firm, in its application form for allocation of coal blocks, had “fraudulently” concealed the fact that its group firms had previously been allocated five coal blocks.

CBI examines Kumar Mangalam New Delhi: CBI has examined Aditya Birla group Chairman Kumar Mangalam Birla in connection with alleged irregularities in the allocation of Talabira-II coal block to his company Hindalco in 2005.
The CBI’s questioning of Birla, named as an accused in the FIR, came after a special court raised questions over the closure report filed by the agency which has not been accepted. Birla was said to have been examined over his meetings with the then Prime Minister Manmohan Singh, who was also holding charge of coal portfolio, and the then Coal Secretary P C Parakh, another accused in the case. When contacted, Birla group declined to comment on the development. CBI Joint Director (Policy), who is in-charge of media relations, R S Bhatti did not answer phone calls and sms in this regard.
