Court orders police to file FIR in property case

A session court has ordered Delhi police to register a FIR in a case regarding cheating over a property deal. Allegedly the victim in this case had earlier approached another court, where the magistrate summarily dismissed the case and asked the police not to register a FIR. However, a sessions court has come to the victim’s aid and stated that she had all the evidence and the court took congnisance of the case. 

According to the complainant, an agreement was made on 20 September 2011 to get an apartment (50 yards) in Harsh Vihar area of Delhi for the amount of Rs 15.7 Lakh. On demand of Nand Kishore and three other accused, she made the payment of Rs 7.5 Lakh. 

However, one day she was told by one of the accused that sale cannot be executed and she should come and take the amount already paid by her. ‘However, when I visited the office of Kishore and others, they tore the original agreement and refused to make any payment,’ said the complainant. 
ASJ Parmachal has said that burdening the victim to bring all evidence on the record, assuming that she has knowledge about the accused persons, was not justifiable conclusion. ‘The investigating agency has been created with the purpose to make expertise investigation,’ said the judge.
