CBI convinces court, Talwars to face trial

A special Central Bureau of Investigation (CBI) court in Ghaziabad found dentist couple Rajesh Talwar and Nupur Talwar prima facie guilty in the double murder case of their daughter Aarushi and the domestic help Hemraj. The court has ordered formal framing of charges against the dentist couple for murder and destruction of evidence on Friday.

Even the first information given to the Noida police on 16 May 2008 about the murder of his teenager daughter Aarushi by Rajesh Talwar was found to be wrong prima facie. He will now face trail in one additional charge for giving false information to the Noida police, which became the basis of the FIR.

After taking cognizance of closure report of the CBI, the court had charged them for Section 302 and Section 201 of the Indian Penal Code. But, after hearing the public prosecutor, the court added Section 203 (giving false information to police) to the list.

'The documents presented before the court prove that both the accused are prima facie guilty of Section 302/34, 201/34 of the Indian Penal Code (IPC) and Dr Rajesh Talwar has also been found prima facie guilty under Section 203 of IPC. It will not be justified to acquit them. The documents should be presented in the court on 25 May 2012 for formally framing the above-mentioned charges,' said S Lal, Additional District Judge (CBI), in a six-page order. The formal framing of charges will take place on Friday.

Both Rajesh and Nupur Talwar, along with their family and counsels, were present in the court but were whisked away immediately after the verdict of the court. The judge announced his decision in post-lunch hours in an in-camera proceeding, which was reserved on Wednesday after two days of hearing.

The charges against them are being framed four years after the double murder took place. Aarushi Talwar was found dead in her room in the early hours of 16 May 2008. Rajesh Talwar had lodged an FIR in the Sector 20 police station in Noida that his servant Hemraj killed his daughter and was absconding. On the next day, Hemarj was found dead on the terrace of the Talwars' flat in Sector 25 in Noida while Talwars were on their way to Haridwar.
