Witness turns hostile in Aarushi case

In a major setback to Central Bureau of Investigation (CBI) in the Aarushi-Hemraj double murder case, Umesh Kumar, the then driver of Rajesh Talwar, turned hostile during his deposition in the special CBI court on Friday.
‘Umesh Kumar has turned hostile. He has refused to identify the hockey sticks which were, according to the final report of the CBI, were used in the murder. He accepted that he had taken two hockey sticks from the car and put them in his flat but refused to identify the sticks produced by CBI in the court as evidence item number 4 and 5,’ said B N Singh, prosecutor of CBI in the Ghaziabad court.
The then driver of Talwar is the eighth out of the 13 major witnesses of the CBI in the case.
‘When I went in the flat around 8.30 pm, all the four persons-Rajesh Talwar, Nupur Talwar, Aarushi and their domestic help Hemraj-were present there. I put the hockey sticks in the room and keys of the car on the table and left for my residence,’ said Umesh Kumar in the court.
Kumar also refused to give any further details or information to the CBI.
On Thursday, the CBI had submitted in the court not to record the statement of Talwar’s former domestic help Kalpana Mandal as she was won by the accused.
Mandal was permanent domestic help for Rajesh Talwar but had arranged Bharti as a substitute when she was on leave to visit her home district in West Bengal at the time of double murder. She is presently deployed with Rajesh Talwar’s in-laws in sector 21, Noida.
The defence lawyers accused the CBI of not having any clinching evidence but playing a delaying tactics, so that the bail plea of Nupur Talwar, currently lodged in Dasana Jail, was deferred once more.
The plea is scheduled for hearning in the Supreme Court on Monday, 17 September 2012.
The Supreme Court, in the hearing of the bail plea on 13 August, observed that the accused may influence 13 major witnesses in the case and deferred the case till their deposition is completed.
So far, however, only eight witnesses, including Umesh Kumar, have deposed before the trial court.
