Rebutting the Congress’ accusations, parliamentary affairs minister M Venkaiah Naidu on Thursday said that ‘no politics’ was behind the decision. ‘Action against Mizoram governor is no violation against the Supreme Court’s earlier judgement.
Action has been taken within rules and within the Constitution. There is no politics behind it,’ he said. ‘There are serious allegations. Government has taken note of them and taken action,’ he said adding the President has decided over it after applying his mind thoroughly on it and such decisions are the ‘privilege’ of the government.
Law minister Ravi Shankar Prasad told reporters outside Parliament: ‘The decision to remove Kamla Beniwal, the governor, is in accordance with Constitutional principles and conventions with the due approval of the President of India’. He said that if the government has to say anything more, it will be done on the floor of Parliament.
Earlier in the day, Congress general secretary and Communication department head Ajay Maken tweeted, ‘If Governor Kamla Beniwal was to be removed, why was she transferred to Mizoram only a few days back? #Vendetta Politics.’ Former union minister Manish Tewari said, ‘In 2004, the members of Parliament affiliated to the BJP had gone to court in a PIL protesting against the transfer of certain governors by the then UPA government which was of course legitimately done.
Subsequently, there was a constitutional bench judge order which clearly delineated that because of extraneous political considerations governor should not be removed or transferred. It is incumbent that the home minister informs the country as to why the Governor of Gujarat, who is an elderly lady, was first transferred in a cavalier manner to a North Eastern state.’
Questioning Beniwal’s sacking, senior Congress leader M Veerappa Moily said, ‘The question is what has she done in Mizoram? Is there any impropriety committed which warrants dismissal without any notice?’ He added: ‘This demonstrates the mindset of the present government of NDA. They dismissed two Governors without even showing the courtesy of asking for their resignations.’
Congress ally and NCP chief Sharad Pawar echoed similar sentiment, ‘This is political vendetta and clear violation of Supreme Court judgement. It is most unfortunate how this government has acted.’
