Additional sessions judge Kamini Lau convicted Rusy, 23, Rajesh, 34, and Ravinder, 23, under sections 460 (death or grievous hurt caused by one of several persons jointly concerned in house-breaking by night), 302 (murder) and 392 (robbery) under the IPC.
Rajesh was also held guilty under section 397 (robbery with attempt to cause death or grievous hurt) of the IPC and under the provision of the Arms Act. The court, in its 219-page judgement, said the first aggravating factor was that Resham Rani, the victim in this case, was a senior citizen aged 65 years. ‘The offence of lurking house trespass had been committed after sunset which is an aggravating factor in cases of robbery.
