Telcos that failed in new 2G bids can’t operate: SC

The Supreme Court ruled on Friday that telecom companies that were unsuccessful in availing fresh 2G spectrum and those which did not participate in the auction process would cease to operate ‘forthwith’.
The apex court added, however, that those companies that were successful in the fresh auction held on 12 and 14 November, 2012, would be asked to start their services in their respective circles immediately.
The Department of Telecom (DoT) had asked the Supreme Court to consider allowing it to grant ‘temporary licences’ to such operators till the completion of the fresh bidding process.
The court by its various interim orders had allowed the companies whose licences were quashed by the verdict to continue with the operation till the fresh auction for 2G spectrum was completed.
The bench also clarified that the apex court’s 2 February, 2012, judgement would not be applicable to telecom companies holding spectrum with 900 MHz band.
The apex court added, however, that those companies that were successful in the fresh auction held on 12 and 14 November, 2012, would be asked to start their services in their respective circles immediately.
