A bench headed by Chief Justice P Sathasivam, before whom the matter was mentioned for an urgent hearing by senior advocate Shyam Divan, agreed to list the case for hearing on Friday.
Sippy moved the apex court challenging the Bombay High Court's order refusing to stay the release of the film which is scheduled for Friday.
Ramesh Sippy, who had directed the original movie 'Sholay', is in dispute with his nephew Sasha over the rights of the film which was released in 1975.
