SC to hear power firms’ plea on tribunal order

The Supreme Court has decided to hear the pleas of two power transmission firms, BSES Rajdhani and BSES Yamuna, that challenged the order of a tribunal which had fixed the tariffs for the power sold in the national Capital. The Bench of Justice Ranjan Gogoi and Justice NV Ramana admitted the petition, as counsel CS Vaidyanathan contested the validity, legality and correctness of the order of the Appellate Tribunal for Electricity served on March 2. The two firms want the order set aside. As the court said the matter related to determination of tariff, Vaidyanathan said: “Determination of tariff is contrary to the regulations.” The court, nevertheless, took exception to the petitioners filing voluminous petitions. “Do you expect us not to take up any case in 2015,” the Bench queried. “Is this something to scare the judges?” The order had come on an appeal by the discoms, challenging the July 13, 2012 tariff order of the Delhi Electricity Regulatory Commission.
