SC stays execution of Nithari killer Surinder Koli

The Supreme Court has stayed the execution of Nithari killings convict Surinder Koli by a week. The bench comprising justices HL Dattu and AR Dave passed the order just after Sunday midnight, staying Koli’s execution on an appeal by him. An official of the apex court said that the plea in this regard was mentioned before the bench after midnight and the order was passed at 1:40 am on Monday.

Koli, whose mercy petition was rejected by the President, was to be hanged in the course of the week. ‘We will withhold the execution of Surinder Koli for 7 days and then wait for further orders,’ SM Rizvi, Meerut Jail superintendent said.

The lawyers sought review of the apex court’s 24 July order dismissing the plea to stay the execution of death sentence awarded to Koli. While seeking stay of execution of the capital punishment, lawyer Indira Jaising, along with other advocates, referred to the 2 September verdict of the apex court in which it had held that the review plea of condemned prisoners must be given an open court hearing.
Koli was transferred from the Dasna jail in Ghaziabad to Meerut on 4 September for the execution of his death warrant issued by the CBI court.
