SC sends Talwars to HC on witnesses plea

The Supreme Court on Monday refused to give any relief to Rajesh and Nupur Talwar, taking strong exception to their move of directly approaching the apex court, challenging a trial court order in the twin murder case of their daughter Aarushi and domestic help Hemraj, in which the dentist couple is facing trial in a special CBI court.
Refusing to entertain their petition, a bench of justices B S Chauhan and Dipak Misra asked them to approach the High Court. Talwars had approached the apex court challenging the order of a special CBI court, which had rejected their plea for summoning 14 additional witnesses, including the then CBI joint director Arun Kumar, to record their statements in the twin murder case.
With the apex court refusing to entertain the Talwar couple’s application, the trial court can now proceed with the case to record the statement of the Talwars.
The CBI had told the trial court that the dentist couple killed their teenaged daughter Aarushi and Hemraj and that no outsider was present at the time of the incident. Aarushi was found dead with her throat slit in her bedroom on 16 May, 2008. Domestic help Hemraj was the initial suspect but later on, his body was also found at the terrace of the Talwars’ residence in Jalvayu
Vihar in Noida. The statement of the CBI investigating officer A G L Kaul, the last prosecution witness, has already been recorded. In his deposition before the additional judge, Kaul, who headed the CBI probe, had told the court that their investigations revealed no evidence of any third person's entry in the house. Earlier CBI had countered the Talwars’ plea in which they had sought deposition of former CBI joint director Arun Kumar as witness, saying claims made in a press conference during the on-going probe cannot be termed as his final views.
