Sanjay Dutt surrenders, to remain in jail for 42 months

It was back to jail for Bollywood actor Sanjay Dutt who on Thursday surrendered before a special court to complete his prison term in the 1993 Mumbai bombings case, adding one more chapter in a life story that could rival one of his films.

Curious crowds and scores of camera crews had gathered outside his Bandra residence since morning and continued to be there till he drove out in the afternoon in a convoy of cars with his friends and family.

Dressed in a white kurta, with cropped hair and a tilak on his forehead, a visibly emotional Sanjay waved before walking hand-in-hand with wife Manyata towards his car.

The crowds continued to mob him even when his motorcade reached the sessions court complex in south Mumbai. As people strained to catch a glimpse of the star, Sanjay was unable to get out of his car. He could do that only after director Mahesh Bhatt requested the crowds to move back.

And the crowds still surged, leading Sanjay to get hurt in the chest, said his lawyer Rizwan Merchant.

Accompanied by Manyata and sister Priya, Sanjay came out of the vehicle and begged with the crowds to let him surrender. He declined to make any comment on any issue.

He was whisked away by security personnel inside the special TADA Court to complete the post-surrender formalities.

ACTOR LIKELY TO FILE CURATIVE PETITION IN SC

Bollywood actor Sanjay Dutt, who surrendered on Thursday before a special TADA court here, is planning to file a curative petition before the Supreme Court, his lawyer said. ‘We are planning to file a curative petition in the apex court soon,’ Dutt’s advocate Rizwan Merchant told special TADA Judge GA Sanap when the proceedings were on to take the 53-year-old actor into custody.

Dutt had earlier filed a review petition in the apex court against its 21 March judgement upholding his conviction under the Arms Act and sentencing him to five years in jail. The apex court had, however, rejected the review petition and directed him to surrender by 16 May.

After review petition, a convict is left with the option of filing a curative petition or a pardon petition.

The concept of curative petition was evolved in 2002 by a SC judgement to cure any defect that may lead to gross miscarriage of justice in a final judgement/order of the Supreme Court, after dismissal of a review petition.

ACTOR ALLOWED TO TAKE MATTRESS, SHAMPOO, MOSQUITO REPELLENT IN JAIL

Actor Sanjay Dutt is allowed to take inside the jail his mattress, pillow, copy of Hanuman Chalisa, Ramayan, Bhagvad Gita and his own toiletries including toothpaste, shampoo, slippers, kurta pyjama and mosquito repellent and a fan. The court did not allow him to take cigarettes not even electronic cigarettes. Special judge GA Sanap told Dutt when he appeared in the box a little after 4pm. ‘I am allowing your everything except cigarettes.’ And then added with a smile, ‘stop it (the cigarette smoking).’
