Road mishap: Victim’s kin get Rs 22 L compensation

Family members of a 36-year-old man, who died after being hit by a rashly-driven motorcycle, have been awarded a compensation of over Rs 22 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed IFFCO TOKIO General Insurance Company Limited, with which the offending motorcycle was insured, to pay Rs 22,52,520 to the family members of Amrit Lal. ‘In view of testimony of witnesses and documents on record the negligence of driver of offending vehicle has been prima facie proved,’ MACT Presiding Officer Harish Dudani said.
Amrit’s family had approached the tribunal seeking a compensation of Rs 70 lakh.
According to the petition filed by Amrit’s family, on 23 July, 2011 he along with his driver was going to supply water bottles in a tempo here. When his vehicle took a U-turn under the Rajokri Flyover for going towards Mahipalpur, it broke down.
Amrit kept several water bottles on the road around his tempo and was getting the traffic diverted when a motorcycle, being driven by Rajesh Sharma in a rash and negligent manner, hit him.
Due to the forceful impact, Amrit fell down on the road and sustained head injuries. He was taken to Safdarjung Hospital where doctors declared him as brought dead.
The victim’s family, residents of Uttar Pradesh, told the tribunal that Amrit was working in a private company and was earning Rs 15,000 per month.
The insurance company, through a written statement, contended that the victim had wrongly parked his tempo on the road and hence he was responsible for the accident. The tribunal, however, rejected their
contentions.
