Family members of a 38-year-old man, who died in a road accident involving a rashly driven tempo, have been awarded around Rs 18 lakh by a Motor Accident Claims Tribunal (MACT). MACT presiding officer Sanjeev Kumar Singh directed ICICI Lombard General Insurance Company Ltd, insurer of the tempo in which victim Mahboob Hasan was traveling at the time of the incident, to pay Rs 17,98,705 to his wife and two children.
The tribunal noted that the tempo’s driver rammed it into the backside of another vehicle resulting in Hasan’s death. “After considering all documents filed by the petitioners as a whole it is clear that respondent No 1 (driver) was driving the vehicle in a rash and negligent manner. I award Rs 17,98,705 as compensation,” the tribunal’s president said, while directing the insurance firm to deposit the amount.
According to the petitioners, on September 1, 2013, Hasan, a businessman, was returning from Moradabad in Uttar Pradesh to Delhi in a tempo. He was sitting in the cabin of the tempo when its driver rammed it into the rear portion of a vehicle from behind on Moradabad-Delhi Road, resulting in his death.
