SC on Thursday dismissed a petition filed by a former SP MLA Kishore Samrite against Cong General Secretary Rahul Gandhi for alleged confinement and rape. The court said that the petition was primarily aimed at hurting the reputation and image of Rahul Gandhi out of ulterior motives and political vendetta.
‘The allegation is without substance and without an iota of evidence,’ a bench of justices B S Chauhan and Swatanter Kumar said. The court also said that he petition filed against Gandhi was misconceived and that Samrite abused the process of law on the basis of incorrect statement.
The court said, ‘The petition filed by him was not bonafide and there was no case of illegal confinement as the girl, who was allegedly kidnapped, had made no complaint.’
SC imposed a fine of Rs 10 lakh on Samrite and also said that the CBI enquiry against him will continue.
Samrite has been oredered to pay Rs 5 lakh to Rahul Gandhi for filing baseless petition and Rs 5 lakh to the girl and her parents as compensation.
