Prosecutor for Mirchpur Dalits killing case

Hearing a bunch of petitions against a trial court order in 2010 Mirchpur Dalits killing case, the Delhi High Court has asked the Delhi Government to appoint a prosecutor to assist the court.

A Delhi court had last year acquitted 82 accused persons and had held 15 guilty of various criminal acts in the case of burning alive of a 70-year-old Dalit and his physically-challenged daughter at Mirchpur village in Haryana two years back. The lower court had, however, did not held guilty either of the 15 accused on charges of murder. Three were held guilty for culpable homicide not amounting to murder for torching houses of victims.

All arrested people were from Jat Community who were alleged to have killed 74-year-old Tara Chand and his 17-year-old handicapped daughter. The attackers allegedly had burnt Chand's hut following a quarrel between Dalit and Jat leaders over a dog raking nearby area in 2010. The accused persons were booked for murder, arson, rioting and also under the SC/ST act.

Earlier this year, the High Court had issued notices to 57 people on a bunch of appeals by victims of the Mirchpur caste violence case. Kamla, wife of deceased Tarachand [victim[, her son and three others have sought enhancement of punishment for the 12 accused and conviction of the three accused who were awarded life imprisonment under the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act under Section 302 [murder] of the Indian Penal Code as well.

They have also sought conviction of the 82 persons acquitted by the trial court for want of credible evidence.

However, the Bench had issued notices only to 42 of them saying the prosecution had not produced sufficient evidence.
