Property dealer put on trial for allegedly kidnapping, beating MCD official

A property dealer has been put on trial by a Delhi court for allegedly kidnapping, assaulting and trying to frame an MCD official in a false bribery case for demolishing some unauthorised constructions here.
Additional Sessions Judge V K Bansal dismissed the plea of accused Tara Chand Yadav, a property dealer here, challenging a magisterial court order that had framed the charges against him for various offences including kidnapping and injuring a public servant under IPC.
The court said prima facie the offences were made out against the accused and facts show that a conspiracy against the MCD Junior Engineer existed. “It is well settled that rarely there is direct evidence of conspiracy as conspiracy is hatched in secrecy. Existence of conspiracy can be informed from the facts and circumstances of the case,” the judge said. “Keeping in view the submissions and the facts of the case I found that in the complaint there is mention that the victim was taken to the office of Yadav where he was abused, beaten and forced to touch the feet of the persons present and money was given in his hand and photographs were clicked...
“Complainant (official) told that Yadav was acting as a judge and all was done at his instance. It is well settled that rarely there is direct evidence of conspiracy as it is hatched in secrecy. Existence of conspiracy can be informed from facts and circumstances of the case,” the court said.
