Phoolka accuses Modi govt, CBI of shielding Tytler in 1984 riot case

Senior lawyer H S Phoolka on Wednesday alleged that Modi government is shielding the 1984 riot accused Jagdish Tytler. Phoolka said that on December 24, 2014, CBI had given a clean chit to Tytler. This was the third time that CBI gave a clean chit to him. Earlier, on two occasions the Court had rejected the clean chit and directed further investigation.
The court on Tuesday took a serious note of this and directed the CBI superintendent of police to appear in the court on February 22, the next date of hearing, for an explanation, Phoolka said.
In this context, Phoolka, along with AAP leaders Sanjay Singh and Ashutosh, said that the Union minister for food processing industries Harsimrat Kaur Badal of the Shiromani Akali Dal had no right to continue in the Modi government.
Phoolka said the CBI, on February 2, had filed the closure report in the court and did not even inform the victim or the media. Phoolka said he got the information from a source.
He said the order of judge SPS Laler of the Karkardooma Court on December 4 last year clearly showed that the earlier clean chits were wrongly given to Tytler.
“Infuriated at the illegal action of the CBI, the court had directed that it would monitor the investigation, besides directing the CBI to submit the status report on the progress of investigation against Tytler on February 2,” he said.
On Tuesday, the CBI neither filed the status report nor was any officer present before the court to inform it about the progress in investigation.
Phoolka argued before the court that the CBI was continuing to shield Tytler and its recent conduct showed that it had no respect for the judicial orders.
“It appears that the CBI did not file the status report intentionally as it wanted to avoid the present judge, who had rejected their clean chit and passed a strong order against the CBI on December 4 last year. Now, judge SPS Laler was being transferred and will likely hand over the charge next week,” Phoolka added.
