Patiala House court may try Italian marines

The case of two Italian marines accused of killing two Indian fishermen is likely to be tried by a special Patiala House court in the national capital. The Delhi High Court has recommended the name of Chief Metropolitan Magistrate (CMM) of Patiala House Courts to the central government for conducting the proceedings.
It has been learnt that the name of Amit Bansal, CMM of New Delhi district, has been forwarded to the central government and sources said that an official notification for setting up of the special court will follow and it will be issued by the Delhi government. The Supreme Court on 18 January had directed the central government to constitute a special court.
The central government had approached the high court to set up a special court to hear the case of Italian marines Massimiliano Lattore and Salvatore Girone, who have returned a few days back to India to face trial for allegedly killing two Indian fishermen off the Kerala coast.
These two Italian Marines were allowed by the Supreme Court on 22 February to go to Italy for four weeks for casting their votes and then to come back to India to face trial. However, Italy had later said that they would not come back to India to face trial, triggering a diplomatic crisis between the two countries. The matter was then taken up between the two countries and the two marinescame back on 22 March.
The Kerala police, on 18 May last year, had filed a charge sheet in a court at Kollam in Kerala against the two marines charging them for the offence of murder under IPC and also invoking the International Maritime Law.
After filing of the charge sheet, the marines had moved higher courts, including the apex court, challenging the jurisdiction to try them in India alleging that the alleged offence had took place in International waters.
The Supreme Court, however, had dismissed their plea and had directed the Centre to set up a special court outside Kerala to hold the trial in the case.
