Noida court orders FIR against Supertech for flouting norms

In pursuance of the order, the Noida Police have registered a case of fraud and cheating against Supertech’s managing director RK Arora at Dadri police station. ‘We have registered a case on court’s direction and are investigating it. We will decide future course of action after consulting interrogating the accused,’ said a senior police official who is investigating the case.

He further informed that a case under Sections 420, 467, 468 and 471 of IPC have been registered against Arora. Police informed that Arvind Kumar Singh, the complainant who lives in Greater Noida had moved court seeking penal action against the builder for cheating.

The complainant has alleged that the design of his flat, booked in a project of Supertech in Noida Sector 58, has been totally changed in comparison to what was shown to him earlier. He also alleged that the construction is being carried out by violating norms of the proposed master plan and is totally different from what was mentioned in the brochure.  The Supertech group has been accused of violating building norms in the past as well. Earlier in April, the Allahabad High Court had ordered the demolition of two 40-storey residential towers of Supertech’s Emerald Court in Noida’s upscale Sector 93A for flouting building norms.

The HC ruling sent shock waves across the booming real estate market in the National Capital Region.

Supertech initially sought permission to build 24 floors but later increased it to 40 (after seeking approval from the requisite authority), which had bothered the court. The court stated, ‘It has repeatedly come to notice that builders, by joining hands with officers of the development authorities, flout every conceivable rule, including building regulations.’

According to the UP Apartment Act 2010, the developer has to take permission before making amendments to the initial construction plan.
