Creditors of firms which did not win mines may be paid: Delhi HC
Delhi High Court on Friday set aside its restraint on the government paying the secured creditors of companies, which had failed to win the coal blocks earlier allocated to them and were deallocated on the orders of the Supreme Court. A bench of justices Badar Durrez Ahmed and Sanjeev Sachdeva modified its orders of March 19 and March 27 by deleting its direction of "not to proceed with satisfaction of the security interest of the secured creditors". It passed the order on the applications moved by various iron, steel and power companies, like GVK Power, Jayaswal Neco, Sarda Energy and others, which had sought that the money collected by the government from successful bidders may be released to the secured creditors. The bench was not convinced by the government's opposition to these companies' pleas, saying "we do not see how could there be an opposition when their (companies) main petition is challenging compensation amount computed by the respondents (Centre) and is seeking enhancement of amount computed".
