A 44-year-old man has been sentenced to rigorous imprisonment for life by a Delhi court for burning alive his wife as he suspected her of having an extra-marital affair.
The court took a lenient view towards convict Maya Deen since he has four children, maintaining that great injustice will be done to them if a harsh view is taken towards him as the kids will be left alone in the absence of their parents. Additional sessions judge Kamini Lau also relied on the dying declaration of 40-year-old victim Manju which corroborated with the police version.
In her dying declaration to a magistrate, she had also said that her husband had set her on fire, the court said.
When she was shifted to the hospital, she had informed the police officials and doctors that her husband had poured kerosene oil upon her and burnt her.
‘Though what Maya Deen has done does not entitle him to any leniency and severest punishment is required to be given to him yet keeping in view the circumstances of the case, I feel that great injustice would be done to his four children, two of whom are girls hardly aged 6 years and 4 years, in case a harsh view is taken’.
‘Convict Maya Deen is hence sentenced to rigorous imprisonment for life and fine to the tune of Rs 10,000 for the offence under Section 302 (murder) of the Indian Penal Code,’ the judge said.
According to the prosecution, on 29 November last year, Pitampura resident Maya Deen murdered his wife by pouring kerosene oil upon her and setting her on fire. She had received 90 per cent burn injuries.
