Man gets 10 years for peddling heroin

A man has been sentenced to 10 years in jail by a Delhi court for carrying from Punjab over seven kilogram of heroin for sale here in the Capital.

While convicting 52-year-old Punjab native Tarsem Singh under the Narcotics Drugs and Psychotropic Substances (NDPS) Act, Special Judge M K Nagpal also imposed a fine of Rs one lakh on him.

The court held Singh guilty saying he was the part of the conspiracy to import the contraband here from Punjab.

‘It is held that the prosecution has successfully proved its charges against accused for offences under Section 21 (c) and 29 of the NDPS Act pertaining to the possession and being part of a criminal conspiracy with Shera (who could not be apprehended during the probe) to deal in contraband substances and to import the above quantity of heroin to Delhi from Punjab,’ the judge said.

Singh was arrested on 2 January 2009 by the Directorate of Revenue Intelligence (DRI) sleuths, acting on a tip off that two persons would be entering Delhi through Singhu border, carrying some narcotics in a vehicle to deliver it to someone else here. On the tip off, a DRI team waited for them at Singhu Border and signalled the suspect’s vehicle to stop, but the driver sped it off and stopped at G T Karnal road only after a chase.

In its complaint, the DRI told the court that Singh, who was driving the Tata Sumo car, tried to escape but he was apprehended while his accomplice Shera managed to escape in darkness and dense fog.

The DRI complaint added that following search of the vehicle, eight packets containing over seven kilograms of contraband heroin was recovered.

During his trial, Singh said the vehicle belonged to one Pargat Singh and he had been driving it for the last two years and was being paid a monthly salary for it. He claimed innocence saying he was falsely implicated in the case and no contraband was recovered from his possession.

He said he and Shera, who had hired his vehicle to pick some of his relatives from the IGI Airport here, were taken to DRI office but he was implicated in the case while Shera was let off by the DRI officials.

The court, however, convicted Singh saying the DRI has proved its case against him.

‘In the instant case the prosecution is found to have proved on record the guilt of the accused beyond reasonable doubts because the evidence led on record does not create any reasonable doubts in the mind of the court regarding the trustworthiness of the same,’ the court said.
