Man booked under POSCO

The accused, Chhotu Singh (25), a road side tea vendor, had committed this act with a minor, who use to reside along the road side with her parents and studied in a MCD-run school.

According to prosecution on 4 April 2013 she was sleeping on the footpath near Bangla Sahib Gurudwara, when Chhotu, who also resides on the roadside nearby, came and covered her with a blanket and removed her undergarments. After sometime her father arrived at the scene and took off the blanket and witnessed this unpleasant act.

After he was convicted under section 377 of IPC and various section of POCSO act, defence counsel pleaded for leniency, as accused belong to the poor strata of society, who earns from road side tea stall. However additional session judge Bharat Parashar said that such acts leave a bad psychological imprint on the mind of children.

‘Offence committed is serious in nature and kind of act in which convict was indulge leaves a long lasting psychological impression on the mind of children of tender age and needs to strongly dealt,’’ said the court. It announced rigorous imprisonment of five years under section 10 of POCSO act 2012, while imposing a fine of Rs 5000.
