Labour Min forms amendments for construction workers, builders

The Ministry of Labour and Employment recently came up with amendments to the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 and Building and Other Construction Workers’ Welfare Cess Act, 1996.
Keeping in mind the problems that are cropping up while implementing the Acts, state govts came up with suggestions to amend certain provisions of the Acts. The tripartite Central Advisory Committee, constituted under the BOCW (RECS) Act, 1996 set up a task force to examine various provisions of the acts and recommended some changes to some provisions. It has been proposed that Union territories be included within the definition of ‘appropriate government’ so that they can take appropriate action. Suggestions have come to empower the central government to specify the maximum cost of construction which shall fall within the definition of establishment under clause (j) of sub-section (1) of section 2 of BOCW (RECS) Act.
Also, the existing condition of 90 days work certificate for registration under the Act is a major handicap.
Workers are finding it difficult to register themselves with the welfare board as they do not get 90 days work certificate from the employer on account of migration from one site to another construction site. So it has been suggested that this be done away with along with the criteria of upper age limit of 60 years in order to extend benefits to the workers above 60.
