‘If cops can prove, it happened’

A youth found in possession of 45 gram of heroin has been sentenced to two years in jail with a Delhi court saying that if police evidence inspires confidence, its independent corroboration is not necessary.

Additional Sessions Judge Anju Bajaj Chandna held city resident Tehatar Singh guilty of possessing the drug, rejecting his contention that he was falsely implicated in the case and no public witness was incorporated in his case.

'Law is now settled that if evidence of police officials inspires confidence, it is not essential to ask for independent evidence for corroboration,' said ASJ Chandna, while convicting Singh under the Narcotic Drugs and Psychotropic Substances [NDPS] Act.

The court also imposed a fine of Rs 20,000 on 26-year-old Singh, who, the police said, was arrested by it in October 2010 from Sadar Bazar area on a tip off that he was carrying smack, the drug addicts' slang for heroin.

The prosecution said Singh on search, he was found in possession of 45.20 gram of contraband smack.

During Singh's trial, his counsel contended before the court that his client had been falsely implicated and that no contraband was recovered from him.

The counsel had also said that no public witness joined the proceedings which creates doubt over the prosecution's story.

The judge said, 'I find no force in this contention.’
