Husband framed for wife’s suicide

A Delhi court has framed charges against a man and his three family members for allegedly causing death of his wife for dowry within three months of their marriage in 2011.

Paving way for the trial of the husband, his parents and his sister, Additional Sessions Judge Virender Bhat said there was prima facie strong evidence against the accused as the allegations of victim’s father against them has remained ‘unexplained’.

‘In my opinion, the allegations of harassment and dowry demands contained in the statement of the father of the deceased have remained unexplained and raise a strong suspicion against the accused about their commission of offences punishable under Section 498A [husband or relative of husband of a woman subjecting her to cruelty] and 304 B [causing death by negligence] of the IPC,’ the court said.

The court has now fixed the matter for recording of evidence on 22 September, against four victim’s husband Vijay Tyagi, his parents Subhash Chand and Rekha Tyagi and sister Monika Tyagi. They all are presently out on bail.

‘A precious life has been lost and justice demands that the cause of death and the manner in which death took place should be found out, which can only be done by holding trial. In my opinion, the case calls for a full fledged trial so as to find out the nature of death of the deceased and the circumstances which led to her death,’ the judge said.

The prosecution said the couple got married in May 2011, but soon after their marriage, the bride began facing harassment by her husband and in-laws for bringing insufficient dowry.

The parents of the deceased had given enough dowry, however, the family of the accused kept on harassing the victim, the prosecution said.

Around three months after her marriage, the girl had gone to her parents’ house, where she committed suicide, the prosecution said adding her autopsy revealed internal wounds on her body, suspected to be sustained by her during her stay with her in-laws and husband.

The prosecutor, during the argument on framing of charges, said ‘the material on record demonstrates that the deceased was being regularly harassed for dowry by the accused and she took the extreme step of taking her own life on being fed up by the dowry demands made by the accused’.

It was alleged in the FIR that the parents of the bride was forced to give an expensive car in place of a Maruti Alto car as part of dowry. Despite getting the vehicle and some cash in dowry, the accused continued to harass the woman, which led her to commit suicide.
