The Delhi high court on Friday suspended the extradition of a fugitive Bangladeshi national – Mehfuz Huq – who is wanted in a 23 year-old murder case in the US. Tihar Jail authorities were to hand Huq over to US marshals on Friday following the lower court order.
The court suspended the 9 January order of additional chief metropolitan magistrate (ACMM) to send Huq to the US to stand trial in the murder case registered in 1989.
Justice GP Mittal, suspending the extradition of Mehfuz Huq, also issued notice to the home ministry, external affairs ministry and the Tihar Jail authorities. In an interim order, Justice Mittal said petitioner Huq shall not be sent out of India till the next date of hearing.
Following a Red Corner Notice, Huq was arrested from the IGI Airport by the Delhi police on 10 February 2011. Huq is facing charges in a USA court for the murder of 19-year-old Todd Kelly in Indianapolis.
