FIR against Emaar MGF for delay in hand-over of flat

An FIR was registered on Wednesday evening against real-estate developer Emaar MGF for failing to give the possession of a flat to its buyer. The complainant, Yash Sachdeva, told the police that he first saw an Emaar MGF advertisement about flats coming up in Gurgaon in 2011. Soon after the ad went viral, Sachdeva and many others interested people started booking flats with the company. Sachdeva paid the booking amount of Rs 15 lakh to the developer in July 2011 for a flat in Sector 66 of Badshahpur area. He paid the remaining amount of Rs 72,50,000 over the next few months.

Emaar MGF had promised him possession of the flat by August 2013. However, almost three years later, he is yet to receive the keys to the flat. Sachdeva also alleged the developers have diverted their funds to other projects, due to which they have not handed over several flats yet.

Despite several meetings with the builders, Sachdeva has neither received a refund nor a date for possession of the flat. A resident of Greater Kailash II in Delhi, he says that he can’t afford to pay any more rent and wants his flat from the builder at the earliest.

A case has been registered against Emaar MGF under section 406 (criminal breach of trust) and 420 (Cheating and dishonestly inducing delivery of property) of the Indian Penal Code in DLF Phase I police station. This is not the first time Emaar MGF has been accused of committing fraud or delaying handover of flats.
