Farmer’s land petition in Patwari dismissed

The Allahabad high court on Tuesday dismissed a petition from some farmers of Patwari who had demanded their land back from the Greater Noida Industrial Development Authority (GNIDA).

Yatender Kumar and two others had filed the petition. They wanted GNIDA to return their 0.4215 hectare land and not to construct anything there.

“High court bench of justices Amreshwar Pratap Sahi and Vivek Kumar Birla dismissed their petition.
The petitioners were banking on the case of Harkaran Singh versus state of UP and others of 2011, where the entire notification was quashed and the land had been returned to the petitioners.

In Gajraj and others case too, a full bench had disposed hundreds of petitioners related to Patwari and other villages of Greater Noida and directed GNIDA for payment of 64.7% hiked compensation and 10% developed land.

The court observed that petitioners had already accepted the initial amount of compensation under an agreement entered into in terms of the 1997 Rules.

Thereafter they had also been given the benefit of payment of additional compensation of 64.70%, which had been accepted by them.

The GNIDA had given additional compensation to most of the farmers and developed land was been given to several farmers. Also the process for giving developed land to other farmers was going on and GNIDA had claimed that developed land would be allotted to all the eligible farmers soon.
