EC rejects plea to derecognise Cong

Janata Party chief Subramanian Swamy’s plea to de-recognise Congress party for a loan given to a private company was rejected by the Election Commission on Tuesday. Swamy had approached the commission saying the Congress party had violated rules by giving a loan of Rs 90 crores to a company named Associated Journals Private Limited. The decision was taken after a full meeting of the Commission, headed by Chief Election Commissioner VS Sampath. The commission dismissed the plea holding that it did not fall under any of the grounds specified for de-recognition of a political party.

‘The ground urged by you seeking de-recognition of the party under reference in the present case does not fall under any of the grounds specified under the said paragraph 16A for such recognition,’ the commission said in a letter to Swamy.

After rejection of Swamy’s plea, the Congress took a dig at Swamy saying that it was surprised that the Janata Party chief had no idea about this legal position. ‘That is the legal position. I am surprised that Swamy does not know. He is one who had claimed that he is a legal counsel and had fought so many cases,’ Congress spokesperson Renuka Chowdhary told reporters.

The commission further stated the letter written on 3 November and 5 November by Swamy were not maintainable under paragraph 16A of the Election Symbols (Reservation and Allotment) Order, 1968, which gives powers to the EC to suspend or withdraw recognition of a recognised political party for its failure to observe Model Code of Conduct or follow its  directions.
