Delhi International Airport Ltd (DIAL) on Monday urged Delhi High Court to dismiss a plea seeking direction to CBI to lodge a case on “alleged bungling” in the leasing of around 5000 acres of prime land of Delhi airport to private companies for modernisation.
“Maintainability of the plea seeking direction to CBI on alleged illegalities and irregularities on the basis of CAG report has already been dismissed by the division bench (of this court) in the negative,” DIAL submitted before a bench of Chief Justice G Rohini and Justice Jayant Nath. In its affidavit, it said the “petitioner has after eight -and-half-years preferred application for revival of the writ petition contending that as the Supreme Court has now decided the matter on account of which the writ petition was adjourned sine die, the writ petition should be revived now.”
“The attempt by the petitioner to revive the present application on the basis of CAG report is patently illegal and not maintainable as it offends the constitutional mechanism of the country,” DIAL said, adding that the petition was solely based on the CAG report.
