The Chief Metropolitan Magistrate Court on Thursday ordered all nine accused members of Akhil Bharatiya Vidyarthi Parishad (ABVP) to appear before the court to give their consent or refusal for lie detector test in the case missing of the Jawaharlal Nehru University's student Najeeb Ahmed.
The court dismissed their plea where they have claimed that they cannot be asked by the Delhi Police to give their consent for the test.
Magistrate Sumit Dass summoned the students to appear before the court on April 6 and state if they are willing to undergo the lie detector test or not.
The court stated that it will not entertain any further applications regarding the issue of consent from their lawyers. It also refused to give any more leniencies on the matter and refused a plea for more time. The lawyers of the accused had cited exams and vacation schedules as the reasons of delay.
Earlier, the accused had approached the court challenging the notice sent to them by the Crime Branch seeking their presence before the magistrate for recording their statement that whether they were willing to undergo the test.
Sumit Dass who was scheduled to pass the order had deferred the matter saying that the order was not ready. March 15, the court had reserved its order after the counsel appearing for the students submitted that the "lie detector test is unconstitutional and illegal unless it is voluntary."
