Delhi Police waiting for a ‘complaint’ to register FIR

A police official privy to investigation told Millennium Post, “So far the case is blind, despite all the plausible angles are being investigated. We cannot file an FIR taking a cognizance in the case. Also, we do not have a complainant to file an FIR.”

To register an FIR, relevant sections of the Indian Penal Code need to be proved or suspected, on the basis of which an FIR is registered with the concerned police station. “We cannot conclude that the case is a murder, suicide or abetment to suicide, though we are still open for investigation,” the officer added.

Several injury marks were found on Sunanda’s body but it cannot be the cause of her ‘unnatural’ death. She was also thrashed by her husband Tharoor in the flight to Delhi, a day before she was found dead. However, sources claim that presence of external injuries suggesting violence against her is an indication that something was wrong with her.

The Sub Divisional Magistrate (SDM) had submitted his report at the Sarojini Nagar police station and endorsed the AIIMS medical board report claiming that Sunanda died due to poisoning. A Central Forensic Sciences Laboratory (CFSL) team and members of the AIIMS board conducted an autopsy and submitted the report few months ago.

The SDM report, according to a police official, suggests that it is a case of poisoning. Further, the report explains that the death could be a suicide, homicide or an accident. After AIIMS medical board and SDM have submitted the report, Delhi Police were directed to carry out their investigation on these three lines — suicide due to poisoning, homicide by giving a poison or accidentally she consumed poison causing unnatural death.

The report was submitted in November after which Delhi Police revisited the crime scene — Suite No 345 at Leela Hotel in South Delhi. But even after 11 months, the Delhi Police are still groping in the dark.
