Delhi govt notifies sale in unauthorised colonies now

With polls fast approaching and about 40 lakh voters residing in unauthorised colonies, the Delhi government last week issued a notification removing all hurdles in the sale and purchase of properties in such colonies. The government had regularised 895 of the 1,218 unauthorised colonies on 8 September last year.

The notification issued on 12 March 2013 and signed by Secretary (Urban Development) RK Srivastava permits registration of sale deed in transfer of properties in private land in unauthorised colonies. ‘In accordance with Para 2.2 of the Revised Guidelines-2007 for Regularisation of unauthorised colonies in Delhi as received from the Ministry of Urban Development, Government of India under letter No-0-33011/2/94-DDIIB-Vol-XI dated 5th October, 2007 and also in accordance with the orders of even number dated 12.12. 2007 and September 9, 2012, the Lt-Governor of Delhi hereby permits the registration of sale in transfer of properties in private lands of unauthorised colonies,’ says the order. The order says under category (A) ‘the registration of the sale in transfer of properties in private land will be allowed as per laid down procedure and formalities under the Registration Act.’ In the notified land and awarded land categories, the registration of sale of properties will be allowed after withdrawal of notification issued for acquisition or de-notification of the land under Section 48 of Land Acquisition Act as may be, mentions the order.

For the ‘Vested Gaon Sabha Land’ that is the land vested with the Gaon Sabha under Section 81 of the Delhi Land Reforms Act but physical possession is with private owners or their successors, the registration of sale of properties will be allowed after required amendments.
