Court pulls up police over 1994 case against Tunda

Tunda was Tuesday charge sheeted in the case under the Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Explosive Substances Act.
Additional sessions judge Bharat Parashar asked police to clarify whether any fresh evidence has emerged against Tunda while observing that earlier all other accused, arrested in this case, were acquitted of TADA charges.
The court questioned why should one go on a futile exercise and said: ‘If the evidence is the same and the judgment has attained finality, I cannot do anything.’ The court listed the matter for 18 February after the prosecution sought more time. Police had earlier taken Tunda in their custody to quiz him in connection with the case. He was declared a proclaimed offender in the case of recovery of explosive substances registered at south Delhi’s Malviya Nagar police station in 1994. Police also said some accused were arrested 17 January, 1994, and 150 kg explosives and six daggers were recovered from them.
According to police, Tunda is involved in 33 bomb blasts in India between 1994 and 1998, 22 of those in Delhi. The police arrested Tunda on 16 August, 2013, from the Banbasa area of Uttarakhand near the Indo-Nepal border. Tunda, however, has claimed he was not arrested in India but picked up from Nepal.
