Court lets off man accused of raping live-in partner

A man accused of raping her live- in partner for more than two years and fathering her child was let off on Tuesday by a Delhi court which noted that he married the girl during pendency of the case and was even maintaining her and the child.

The court let off the man who told the court that the physical relationship between the complainant and him was always consensual and that he was in fact in love with the girl, who he married during the pendency of the case, and is maintaining her and the child.

‘I find myself unable to accept the case of prosecution that the sexual relations between the accused and the girl were established on the basis of any false assurance of marriage or that the girl was not a consenting party to the same.

‘Admittedly, the girl was about 23 years of age when she started living with the accused. She was a mature woman who willingly started residing with the accused and also established sexual relations with her consent,’ Additional sessions judge Kaveri Baweja said.

The court also noted that the girl had been saying that she wanted to marry accused Tamir, a resident of central Delhi.

In her complaint in June 2012, the girl, a native of Bihar, said she came to Delhi in 2007 in search of work and started working as a casual labourer.

She met Tamir at Patel Nagar Metro station and they gradually developed friendship. She said the accused promised to marry her and she started living with him. She further alleged that they lived together for two years during which the accused developed physical relationship with her on various occasions but kept postponing his promise of marriage.

The girl also alleged that when she pressurised for marriage, the accused turned her out even when she was pregnant with his child.

In his statement to the court, the accused admitted living with the girl for two years but denied establishing sexual relations with her forcibly. He, instead maintained that he loved the girl, who he has married and was bearing all her expenses and that of their child.
