Court grants wife divorce due to husband’s cruelty, desertion

A Delhi court has granted divorce to a woman on the ground of cruelty after it was proved that her husband had married her to fulfil his plan to settle abroad by forcing her to pursue studies there at her parents’ expense.

The court allowed the petition of the Delhi-based woman for a divorce saying she has underwent ‘unbearable’ torture and cruelty at the hands of her Punjab-based husband, who had convinced her to marry him to satisfy his greed and that of his family members.

Additional district judge Sujata Kohli also observed that this is a ‘common phenomena’ in Punjab, where grooms search brides who can fulfil their dream to go abroad.
‘...it is clear that the matrimonial tie between the parties has broken because of the cruel conduct of respondent (man) as it is clear, that it is he, who convinced the petitioner (woman) for the marriage with him to serve his own purpose of greed and that of his family members as well as his purpose to go abroad, as respondent himself was not capable for the same, financially or educationally.’ ‘This is a common phenomena in ‘State of Punjab’ where some grooms are in search of brides, who can get them a foothold abroad, somehow at any cost, attracted by the glamour and green pastures, such grooms stoop down to the extent of ruining the life of young innocent brides,’ the court said.

The woman sought divorce from her unemployed husband on the grounds of cruelty and desertion.
The man, who did not turn up personally in the court, also claimed that he was ready to keep his wife.

The court, however, said from the conduct of the man and his family members, it became clear that he has left the woman with an intention to permanently abandon her and she has been treated with mental as well as physical cruelty by him.

‘Though no doubt that the man in his written statement has spoken much about the sanctity of the matrimonial tie, he has talked about the Indian culture and the marriage being a sacrament and ‘Union of Souls’.
