Court denies bail to man in rape case

A man accused of raping a woman after making a false promise of marriage has been denied bail by a Delhi court which observed that the law ‘tilts’ towards the victim as ‘biologically it’s the woman alone who suffers in a failed sexual relationship’.
The court dismissed the bail application of the man, a resident of north west Delhi, noting that it cannot be said that he was not aware of the consequences of maintaining sexual relationship with a woman. ‘The one thing which needs to be understood is that though legally both man and woman are equal, yet biologically it is the woman who alone suffers the consequences of a failed sexual relationship,’ additional sessions judge Kamini Lau said.
The court added that the accused, who is presently in judicial custody, was not so naive as he was pretending to be. The woman in an FIR had said he was residing in her neighbourhood and developed friendship with her. He took her to a place in Budh Vihar where he raped her after falsely promising to marry her due to which she became pregnant.
