Court asks CBI to file FIRs against owners of illegal constructions

Special CBI judge A K Mendiratta made the observation, while acquitting MCD junior engineer (JE) Ajay Kumar Shrotriya and two others accused of illegally saving unauthorized constructions from demolition in 2002.

The court, however, said that ‘considering the fact that the nexus between the builders, their political bosses and officials from MCD is deeper and unauthorized constructions continue unabated even today, it may be observed that the acquittal of the accused wheresoever in 15 cases prosecuted by CBI does not protect the unauthorized constructions from demolition’.

The judge also said FIRs need to be registered against the owners/ builders as unauthorized constructions continue unabated.

‘It has also been observed in some of the cases that unauthorised basements were constructed in complete violation of building by-laws which even put the adjacent properties in peril’, the court said.

The court directed that departmental action be taken by the commissioner, North Delhi Municipal Corporation/ commissioner concerned of the zone in respective cases against JEs/AEs (other than Ajay Kumar), who are found liable for failing to take demolition action against properties which were being probed by CBI. It also ordered that a copy of the judgement be sent to commissioners of all the three Municipal Corporations and said action taken reports should be placed before it within eight weeks.
