Complaint against two cops dismissed

A court here refused to prosecute two Delhi police officials, including an additional deputy commissioner, for allegedly not taking any action against the encroachers of public land in Capital’s north district. Special Judge B R Kedia refused to prosecute Additional DCP Rupinder Kumar of north district and Roop Nagar Police Station’s SHO Neeraj Kumar saying that no sanction was taken from competent authorities for their prosecution.

The court dismissed the private complaint filed by one Satish Chand Gupta, who had alleged that the two officers had not taken any action against the encroachment in Roop Nagar and Kamla Nagar area in North Delhi. The court said as the sanction by competent authority for prosecuting the two police officers was not taken, it was barred from taking cognisance of the complaint and also that it suffers from “serious legal infirmities.

‘I have no hesitation to safely conclude that in the absence of sanction by competent authority as contemplated under the provisions of the Prevention of Corruption Act for launching prosecution, this court is debarred from taking cognisance of the alleged offence against them and therefore, this complaint deserve to?be dismissed on this count itself,’ the judge said. ‘I have no hesitation to safely conclude that the instant complaint as filed by the complainant suffers from serious legal infirmities and hence, deserves dismissal,’ the judge said.
